GENERAL TERMS AND CONDITIONS OF SUPPLY

Article 1. General

  1. These Terms and Conditions apply to all offers made by Tante Seline Creations (TSC) on its website and to any contract entered into between TSC and a customer through that website.
  2. Any terms and conditions applied by the customer – including terms of purchase – are excluded from this agreement.
  3. The customer is informed of these Terms and Conditions before placing an order on the TSC website.

Article 2. Definitions

The following definitions are used in these Terms and Conditions.

Article 3. Offers, orders, and contract

3.1 A contract of sale is established once the customer has placed an order through the website and has received written confirmation (by e-mail) from TSC.

3.2 The customer may cancel their order unconditionally if TSC fails to deliver the ordered product within 30 days.

3.3 All offers made by TSC on its website include a full and accurate description of the product and a reliable image.

3.4 An offer made by TSC is void if it contains mistakes, errors or omissions.

Article 4. Prices

4.1 When the customer orders a product through the website, the price stated there at the time of sale applies.

4.2 All prices and rates quoted by TSC include VAT, unless otherwise explicitly stated, but exclude shipping costs.

4.3 The shipping costs payable by the customer depend on the volume and destination of the order.

4.4 TSC reserves the right to change its prices for any reason. Revised prices and rates apply from the moment that they are posted on the website.

Article 5. Payment

5.1 The customer pays at least 50 percent of the order price immediately upon placing the order, by transferring the amount to the bank account number specified by TSC.

5.2 The customer is required to pay the remaining amount due to TSC within 14 days after delivery of the order.

5.3 If the customer has not paid for the order in full within 14 days of delivery, TSC will send a reminder by e-mail. The customer then has a further 14 days in which to settle the account. If they have not paid after that period, TSC will charge the customer collection costs.

Article 6. Delivery

6.1 TSC may suspend fulfillment of an order for as long as the customer has not paid at least 50 percent of the purchase price.

6.2 TSC will dispatch the order as soon as at least 50 percent of the purchase price has been paid into its bank account.

6.3 TSC encloses an invoice with every order dispatched.

6.4 TSC notifies the customer by e-mail as soon as their order has been dispatched.

6.5 The order is sent to the address specified by the customer when placing the order. If delivery to that address is not possible, the customer is informed in writing of the address to which the product has been delivered.

6.6 TSC is not responsible for any product ordered once it has been delivered to the customer.

Article 7. Reflection period and returns

7.1 After receiving a product, the customer has a 14-day reflection period during which they may cancel the purchase unconditionally.

7.2 To qualify for the right of unconditional cancellation during the reflection period, the customer may only unpack and view the product to the extent necessary to determine its nature and characteristics.

7.3 If the customer decides during the reflection period not to purchase the product, they may return it at TSC’s expense within 14 days from the date of receipt, in suitable packaging and accompanied by the return shipment form (see below).

7.4. Upon receiving the returned product, TSC sends the customer confirmation of receipt as soon as possible.

7.5 As long as TSC has received the returned product in an undamaged condition, it will refund the amount paid by the customer, including shipping costs, as soon as possible.

Article 8. Complaints

8.1 If the customer discovers any defect in a product they have ordered within the reflection period of 14 days, they should notify TSC by e-mail.

8.2 TSC notifies the customer by e-mail as soon as their complaint is received.

8.3 TSC deals with the complaint within a period of 14 days of receipt.

Article 9. Liability and indemnity

9.1. TSC is liable only for direct loss or damage as a result of failure to deliver an order. In such cases, TSC will pay compensation up to the amount of the order (excluding VAT).

9.2. TSC is not liable for any indirect loss or damage.

Article 10. Force majeure

By force majeure, TSC means any failing in the supply of the product that is not the fault of TSC or that is the result of a product ordered by the customer being temporarily out of stock at TSC or its supplier.

Article 11. Intellectual property

Without the prior written permission of TSC, the customer may not reproduce or utilize any book or other product supplied by TSC, in whole or in part:

1) for the purposes of any company, organization, or institution;

2) for any form of activity, study, or other use that is not strictly private in nature;

3) in any form of newspaper, magazine, or other publication (print, digital, or other), or any broadcast of a radio or television program;

unless explicitly agreed between TSC and the customer.

Article 12. Disputes

Dutch law applies to all contracts and agreements between TSC and the customer. Any dispute arising out of them or these Terms and Conditions is referred exclusively to the competent court in the Netherlands.
